  1. Click4TeeTimes Gift Certificates are issued and sold by Click4TeeTimes, which is part of The Active Network, Inc., a Delaware corporation having its principal location at 10182 Telesis Court, Ste. 100, San Diego, CA 92121.
  2. Click4TeeTimes Gift Certificates are intended solely for sale to residents of the state of California who are 18 and over who have an active account registered with Click4TeeTimes. Residents of or consumers located outside the state of California are not eligible for this program. By participating in the Click4TeeTimes Gift Certificates program, you represent and warrant to Click4TeeTimes and its affiliates that you are a California resident aged 18 years or older.
  3. Click4TeeTimes Gift Certificates must be redeemed solely through the Click4TeeTimes.com website located at http://www.click4teetimes.com, and used toward the purchase of and are available solely for use with certain California based golf courses listed on our website.
  4. Click4TeeTimes Gift Certificates are non-transferable once applied to a member account.
  5. Click4TeeTimes is not responsible for lost or stolen Click4TeeTimes Gift Certificates.
  6. Click4TeeTimes Gift Certificates are not redeemable or refundable for cash or other gift cards or gift certificates and cannot be combined with any other special or free offers.
  7. If your order exceeds the amount of your Click4TeeTimes Gift Certificates, you must pay for the balance with a credit card.
  8. Click4TeeTimes.com will have the right to close customer accounts and request alternative forms of payment if a fraudulently obtained Click4TeeTimes Gift Certificates are either redeemed through the Click4TeeTimes.com website or are redeemed and used to make purchases on the Click4TeeTimes.com website.
  9. Click4TeeTimes.com may provide third parties who have purchased Click4TeeTimes Gift Certificates on your behalf with information about the redemption status of Click4TeeTimes Gift Certificates.
  10. CLICK4TEETIMES AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE CLICK4TEETIMES SERVICE, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A CLICK4TEETIMES Gift Certificates CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF THE APPLICABLE CLICK4TEETIMES Gift Certificates YOU ORIGINALLY PURCHASED.
  11. By visiting Click4TeeTimes.com, you agree that the laws of the state of California, without regard to principles of conflict of laws, will govern these Click4TeeTimes Gift Certificates terms and conditions. You further hereby agree that any formal action advanced pursuant to a dispute relating in any way to Click4TeeTime.com and any products or services provided there through, including without limitation, Click4TeeTimes Gift Certificates, shall be initiated solely within the state or federal courts located in San Diego County, California, and you consent to the exclusive jurisdiction and venue in such courts.
  12. INDEMNIFICATION. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS CLICK4TEETIMES AND ITS AFFILIATES, PARENTS AND SUBSIDIARY CORPORATIONS AS WELL AS THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS AND AFFILIATES FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES (INCLUDING REASONABLE ATTORNEYS FEES) RESULTING FROM ANY BREACH OF ANY OF YOUR OBLIGATIONS SET FORTH HEREIN AND FROM ANY ACT, DEFAULT AND/OR OMISSION (INCLUDING WITHOUT LIMITATION PERSONAL INJURY, DEATH OR DAMAGE TO PROPERTY, CAUSED OR CLAIMED TO BE CAUSED BY YOU THROUGH USE OR REDEMPTION OF OUR PRODUCTS AND SERVICES, INCLUDING WITHOUT LIMITATION THE CLICK4TEETIMES Gift Certificates.
  13. LIMITATION OF LIABILITY. CLICK4TEETIMES AND ITS AFFILIATES, PARENTS, AND SUBSIDIARY CORPORATIONS AS WELL AS THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE, INCIDENTAL OR OTHER NON-DIRECT DAMAGES OF ANY KIND FOR ANY CAUSE OR REASON. CLICK4TEETIME'S MAXIMUM LIABILITY UNDER THIS AGREEMENT FOR ANY REASON OR CAUSE SHALL BE LIMITED TO DIRECT DAMAGES IN THE AMOUNT PAID BY YOU FOR ANY CLICK4TEETIMES Gift Certificates PURCHASED BY YOU GIVING RISE TO SUCH LIABILITY.
  14. Click4TeeTimes reserves the right to change these terms and conditions from time to time in its discretion. Click4TeeTimes will provide written notice of such changes on its website.
